Terms of Service

By using Vokarys, you agree to these Terms of Service. If you do not agree, do not use this service.

Age Requirements: You must be at least 13 years old. Users under 18 must have parental consent.

Changes to Terms: We may modify these terms from time to time. If we make material changes, we will notify you by email or in-app notice where required by law or where appropriate. The updated terms apply from the date they are posted. If you continue to use Vokarys after the changes take effect, you agree to the updated terms.

Vokarys provides AI-powered speech recognition and transcription services. Speech recognition runs on your device. Some recordings (sampled) are uploaded to our servers for research and AI training.

Vokarys also offers AI-generated outputs (for example, summaries, rewrites, or suggestions) using cloud AI providers, including Google Gemini large language models operated by Google Cloud. When you use these features, your content and prompts are processed by these providers on our behalf in order to generate responses.

The service is provided "as is" without warranties. We may update, modify, or discontinue features at any time.

Account Creation: Provide accurate information during registration. You are responsible for keeping your account information current.

Account Security: Keep your credentials confidential. You are responsible for all activity under your account. Notify us immediately of unauthorized access.

One Account Per User: Do not create multiple accounts. Accounts cannot be transferred or sold.

Lawful Use Only: Use Vokarys only for lawful purposes in compliance with all applicable laws.

No Sensitive Information: Do not enter passwords, payment card or bank details, protected health information (PHI), trade secrets, or other highly sensitive personal data into Vokarys. Only provide the minimum personal data needed to use the service (for example, your email to create an account). All data you submit is uploaded to our servers and may be reviewed by authorized personnel.

Prohibited: Do not upload illegal, harmful, threatening, abusive, or harassing content. Do not attempt to reverse engineer, hack, or compromise the service. Do not use automated systems to access the service without permission. Do not violate intellectual property rights. Do not send spam or engage in harassment. Do not use the service for benchmarking, accuracy evaluation, or competitive analysis.

Commercial Use: Requires prior written permission from Vokarys.

By using Vokarys, you grant us a worldwide, royalty-free license to use your voice recordings and transcriptions for:

• AI training and model improvement
• Research into speech recognition technology
• Service improvement and development
• Licensing to third parties for research and commercial purposes

This license continues even after you delete your account to the extent permitted by applicable law. After your account is deleted, we may keep and use de-identified recordings and transcriptions that are no longer reasonably linked to you as an identifiable person, including by licensing them to third parties for research and commercial purposes. When required by law (for example, under GDPR), we will honor your rights to erasure, restriction, and objection in relation to personal data we still hold about you.

This license includes the right for us to send your content to cloud AI providers (such as Google Gemini large language models operated by Google Cloud) so they can process it on our behalf and generate AI outputs for you when you use those features.

We Own the Service: Vokarys owns all rights to the service, including software, technology, algorithms, and branding. The service is protected by copyright and trademark laws.

You Own Your Recordings: You retain ownership of your voice recordings. However, you grant us the license described above to use them.

Your License to Use: We grant you a limited, non-exclusive, non-transferable license to use Vokarys for personal, non-commercial purposes.

No Uptime Guarantee: We strive for high availability but do not guarantee uninterrupted service. The service may be unavailable due to maintenance, updates, or technical issues.

Geographic Restrictions: Vokarys may not be available in all countries.

System Requirements: You need a compatible device, operating system, and internet connection. You are responsible for internet costs.

"As Is" Service: Vokarys is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant merchantability, fitness for a particular purpose, or non-infringement.

No Accuracy Guarantee: AI speech recognition is not 100% accurate. Verify important transcriptions. Do not rely solely on Vokarys for critical decisions.

Not for Medical Use: Do not use Vokarys for medical diagnosis, treatment, clinical documentation, or emergency communication. Vokarys is not a medical device and is not intended to handle Protected Health Information (PHI).

Maximum Liability: Our total liability for any claims shall not exceed the amount you paid us in the 12 months before the claim.

No Consequential Damages: We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption.

You Assume Risk: You use Vokarys at your own risk. We are not responsible for damages resulting from your use of the service.

You agree to indemnify and hold Vokarys harmless from any claims, damages, losses, or expenses (including legal fees) arising from: your use of the service, your violation of these terms, your violation of any law or regulation, or your violation of third-party rights.

You Can Leave: Delete your account at any time through account settings or by contacting hello@vokarys.com.

We Can Terminate: We may suspend or terminate your account immediately for violations of these terms or for any reason.

What Happens After: Your access stops immediately. We may delete your account data. We may retain and use de-identified recordings and transcriptions for AI training and research, even after your account is deleted, as described in these terms and our Privacy Policy. Any outstanding payments remain due.

Governing Law: Czech Republic law governs these terms.

Jurisdiction: Courts in the Czech Republic have exclusive jurisdiction over disputes.

No Class Actions: Disputes must be resolved individually, not as part of a class action.

Entire Agreement: These terms, together with our current Privacy Policy, form the entire agreement between you and Vokarys regarding your use of the service.

Severability: If any provision is found unenforceable, the remaining provisions remain in effect.

No Waiver: Our failure to enforce any right does not constitute a waiver.

Assignment: You cannot assign these terms. We may assign them to any successor.
