By accessing or using Vokarys services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using this service. We reserve the right to modify these terms at any time, with changes effective immediately upon posting.
Age Requirements: You must be at least 13 years old to use this service. Users under 18 must have parental consent. You represent that you have the legal capacity to enter into this agreement.
Voice Recognition Platform: Vokarys provides AI-powered speech recognition, transcription, and voice processing services through web and mobile applications. Primary voice recognition processing occurs locally on your device to ensure privacy and reduce latency.
Service Availability: The service is provided "as is" and "as available" without warranties of any kind. We do not guarantee uninterrupted service availability. We may update, modify, or discontinue features at any time without prior notice.
Account Creation: You must provide accurate, current, and complete information during registration. You are responsible for maintaining the accuracy of your account information and the confidentiality of your account credentials.
Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use. We reserve the right to suspend or terminate your account at any time for violations of these terms.
Account Limitations: You may not create multiple accounts to circumvent restrictions. Each user is limited to one account. Your account is personal to you and may not be transferred, sold, or assigned to any third party.
Lawful Use: You agree to use the service only for lawful purposes and in accordance with these terms and all applicable laws and regulations.
Prohibited Activities: You may not create, upload, or share illegal, harmful, threatening, abusive, or harassing content. You may not attempt to reverse engineer, decompile, or hack the service. You may not send spam, unsolicited communications, or engage in harassment. You may not violate intellectual property rights or use automated systems to access the service without permission.
Commercial Use: Commercial use of the service requires prior written permission from Vokarys.
Local Processing: Speech recognition is performed entirely on your device. We do not access or store your voice recordings unless you explicitly choose to share them with us. The app stores your most recent voice recordings locally on your device for your convenience and to improve recognition accuracy.
Data Sharing: Voice recordings are only sent to our servers when you explicitly choose to share them for AI training purposes. When you share voice recordings, we analyze speech patterns specific to non-standard speech to improve recognition accuracy. This sharing is entirely voluntary and can be disabled at any time.
Data Retention: Voice data processed locally is not stored on our servers. Explicitly shared voice recordings are stored indefinitely to continuously improve our AI models. Voice recordings stored locally on your device remain there until you delete them or uninstall the app.
AI Training License: By explicitly sharing voice recordings, you grant us an irrevocable, perpetual, royalty-free, worldwide license to use your recordings for AI training, research, and service improvement.
Data Sharing License: By explicitly sharing voice recordings, you grant us an irrevocable, perpetual, royalty-free, worldwide license to share or sell your voice recordings with 3rd parties for AI training, research, and service improvement.
Anonymization: We do not store your personal information together with voice recordings and transcriptions. Humans reviewing shared recordings only have access to: country of origin, gender, condition, and speech level impairment. Your identity, contact information, and other personal details are not linked to shared voice data.
AI Training License: By explicitly sharing voice recordings and transcriptions, you grant us an irrevocable, perpetual, royalty-free, worldwide license to use your recordings and transcriptions for AI training, research, and service improvement.
Data Sharing License: By explicitly sharing voice recordings and transcriptions, you grant us an irrevocable, perpetual, royalty-free, worldwide license to share or sell your voice recordings and transcriptions with 3rd parties for AI training, research, and service improvement.
User Control: You have complete control over your voice data. You can view exactly what data you have shared with us through your account settings. You can opt-out of data sharing, delete your account, or request data deletion at any time. You can stop sharing data at any time, though previously shared data may continue to be used for AI training.
Service Ownership: Vokarys owns all rights, title, and interest in the service, including all software, technology, and content we provide. The service is protected by copyright, trademark, and other intellectual property laws.
User Content: You retain ownership of your voice recordings and any content you create using the service. By using the service, you grant us a limited license to process your content as necessary to provide the service.
License Grant: We grant you a limited, non-exclusive, non-transferable license to use the service for personal, non-commercial purposes in accordance with these terms.
Free Service: Basic voice recognition services are provided free of charge. Premium features may require a paid subscription with advanced features, increased usage limits, and priority support.
Payment Terms: Paid subscriptions are billed in advance on a monthly or annual basis. Payment is due immediately upon subscription activation. We reserve the right to modify subscription pricing with 30 days' notice.
Refund Policy: Refunds are generally not provided for digital services. We may consider refunds on a case-by-case basis for technical issues or service failures. You are responsible for all applicable taxes, duties, and fees.
Uptime: We strive to maintain high service availability but do not guarantee uninterrupted access. Service may be temporarily unavailable due to maintenance, updates, or technical issues.
Geographic Restrictions: The service may not be available in all countries or regions due to legal or technical restrictions. The service requires compatible devices and operating systems with minimum requirements specified in our documentation.
User Responsibilities: You are responsible for your internet connection and any associated costs. The service may require significant bandwidth for optimal performance. You must keep your software and applications updated to ensure compatibility and security.
Service "As Is": The service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
No Guarantees: We make no guarantees regarding the accuracy, reliability, availability, or completeness of the service or any content provided through the service.
Limitation of Damages: To the maximum extent permitted by law, our total liability for any claims arising from or related to the service shall not exceed the amount you paid us for the service in the 12 months preceding the claim.
User Assumption of Risk: You use the service at your own risk. We are not responsible for any damages, losses, or consequences resulting from your use of the service.
User Termination: You may terminate your account at any time by contacting us or using the account deletion feature in your settings.
Service Termination: We reserve the right to terminate or suspend your account immediately, without prior notice, for any reason, including violation of these terms.
Effect of Termination: Upon termination, your right to use the service ceases immediately. We may delete your account data, though some data may be retained as required by law or for legitimate business purposes.
Voice Recognition Accuracy: While we strive for high accuracy, AI speech recognition is not 100% accurate. Users should verify important transcriptions and not rely solely on automated results for critical decisions. The first 50 voice recordings typically provide the most significant accuracy improvements, with additional recordings providing smaller incremental benefits.
Medical/Healthcare Use: This service is not intended for medical diagnosis, treatment, or healthcare applications. Do not use for medical purposes without appropriate professional oversight.
AI Training Transparency: When you choose to share voice recordings for AI training, this data helps improve recognition accuracy for all users. Shared recordings are transcribed and used to train our AI algorithms, helping improve recognition for all users with similar speech patterns. Shared data may be used indefinitely for algorithm improvement. If you choose not to share any voice recordings with us, you will not see accuracy improvements over time.
Non-Standard Speech Focus: We analyze speech patterns specific to non-standard speech to improve recognition accuracy. Recognizing non-standard speech is particularly challenging, and we rely on user-shared recordings to improve accuracy.
Local vs. Cloud Processing: Voice recognition primarily occurs on your device for privacy. Cloud processing is optional and clearly indicated when used. Only voice recordings you explicitly choose to share are processed on our cloud servers.
Governing Law: These terms are governed by the laws of the Czech Republic, without regard to conflict of law principles.
Jurisdiction: Any disputes arising from these terms or your use of the service shall be subject to the exclusive jurisdiction of the courts in the Czech Republic.
Class Action Waiver: You agree that any disputes will be resolved individually and not as part of a class action or consolidated proceeding.
